These Terms & Conditions ("Terms") govern your use of the Newelna mobile applications and related services (the "Services"), including the Newelna customer app and the Newelna Store, Provider, and Worker partner apps. By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use the Services. By using Newelna you confirm that you meet these requirements.
2. Your Account
- Customers sign in using their mobile phone number and a one-time verification code (OTP). Partner accounts (Store, Provider, Worker) are provided by Newelna.
- You are responsible for keeping your account and device secure and for all activity that occurs under your account.
- You agree to provide accurate, current information and to keep it up to date.
3. The Service
Newelna is a technology platform that connects you with independent restaurants, stores, drivers, and service providers. Newelna facilitates ordering, delivery, rides, parcels, and on-demand services, but the products and services are provided by these independent third parties. Availability of stores, items, and services may vary by location and time.
4. Orders, Bookings & Payments
- Prices, fees, delivery charges, and taxes are shown before you confirm an order or booking. By confirming, you authorize the applicable charge.
- Payment may be made by cash on delivery or via your in-app wallet or other supported methods.
- Estimated preparation, delivery, and arrival times are estimates only and are not guaranteed.
- You are responsible for providing an accurate delivery address and contact details.
5. Cancellations & Refunds
Cancellation and refund eligibility depend on the status of your order or booking and the policies of the relevant store or provider. Where a refund is due, it is processed to your original payment method or your in-app wallet. Once a provider has begun fulfilment, cancellation may not be possible.
6. Acceptable Use
- Do not use the Services for any unlawful, fraudulent, or harmful purpose.
- Do not misuse, disrupt, or attempt to gain unauthorized access to the Services or other users' accounts.
- Do not submit false orders, abuse promotions, or harass drivers, providers, or staff.
7. Partners (Stores, Providers & Workers)
If you use a partner app, you agree to provide accurate listings, pricing, and availability; to fulfil accepted orders and bookings promptly and professionally; and to comply with applicable laws and any commission or payout terms agreed with Newelna.
8. Promotions, Coupons & Wallet
Coupons, cashback, referral rewards, and wallet credit are subject to their specific terms and may be changed or withdrawn at any time. They have no cash value except as used within the Services and may not be transferred or sold.
9. Intellectual Property
The Newelna name, logo, apps, and content are owned by Newelna and its licensors and are protected by law. You may not copy, modify, distribute, or create derivative works without our written permission.
10. Third-Party Services
The Services rely on third-party providers (for example, Google Maps, Firebase, and payment processors). Your use of those features may be subject to the third parties' terms. We are not responsible for third-party services.
11. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or that any product or service obtained through the platform will meet your expectations.
12. Limitation of Liability
To the maximum extent permitted by law, Newelna shall not be liable for any indirect, incidental, special, or consequential damages, or for the acts or omissions of independent restaurants, stores, drivers, or service providers. Our total liability for any claim relating to the Services is limited to the amount you paid for the order or booking giving rise to the claim.
13. Termination
We may suspend or terminate your access to the Services at any time if you breach these Terms or misuse the Services. You may stop using the Services and delete your account at any time (see our Privacy Policy for account deletion).
14. Changes to These Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, notify you in the app. Continued use of the Services after changes take effect means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of Lebanon, and any disputes shall be subject to the competent courts of Lebanon, without regard to conflict-of-law rules.
